==Kaplan's killing and decline== Police arrested Kaplan for carrying a concealed weapon on August 28, 1923. While detectives escorted him from Essex Market Court toward a taxi, a gunman shot him dead and wounded the driver. ''The New York Times'' called Kaplan a notorious East Side gang leader and gunman.<ref name="NYTKilling">[https://www.nytimes.com/1923/08/29/archives/gang-leader-slain-at-court-house-door-as-police-guard-him-gunman.html “Gang Leader Slain at Court House Door as Police Guard Him”], ''The New York Times'', August 29, 1923.</ref> Louis Cohen, also identified as Louis Kerzner, was arrested at the scene. A grand jury indicted him for first-degree murder two days later.<ref>[https://www.nytimes.com/1923/08/31/archives/-dropper-is-buried-his-slayer-indicted-heavy-guard-of-police-keeps-.html “‘Dropper’ Is Buried; His Slayer Indicted”], ''The New York Times'', August 31, 1923.</ref> Cohen's connection with Orgen's side supports the factional-war context, but later claims that Buchalter, Shapiro or Diamond ordered the shooting require attribution rather than treatment as adjudicated fact. Kaplan's death broke the Rough Riders' position, and Asbury says his men quickly dispersed.<ref name="Asbury" /> The [[Little Augies]] were rivals that benefited from the resulting opening, not a clean institutional successor. This was displacement and recruitment of individuals, not a documented merger of two intact organizations.
